My brother recently sent me a tablet computer by post. The cost is RM2,000. He sent it through a courier company and had to pay for insurance and extra for security purposes. It was supposed to arrive in 2 day’s time. After a week, I called the courier company with my tracking number only to find out that they suspect the package to be lost. They told me that they will compensate for my loss. My question is, would the refund be below RM2,000 and can I ask for further damages as it has valuable data in it?
The company would usually compensate you based on the amount that was declared by your brother prior to shipping it. This means that you will most likely not get anything more than RM2,000. This is agreed to and accepted by the sender when he signed the document. However, if you want to pursue further for more damages, you can bring it up with the Consumers’ Tribunal which would then be decided by the court.
